Terms of Service

1. Acceptance of Terms

By accessing or using the ReefCast AI platform — including our website, mobile web application, and any associated services (collectively, the “Service”) — you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and ReefCast AI (“we”, “us”, or “our”), operated from Cairns, Queensland, Australia. We may update these Terms from time to time. Continued use of the Service after any changes constitutes your acceptance of the revised Terms. We will notify registered users of material changes by email or in-app notice.

2. Description of Service

ReefCast AI is an AI-powered reef fishing companion platform designed for anglers in the Cairns and Great Barrier Reef region of Queensland, Australia. The Service provides:

• AI-powered fishing recommendations and predictions
• Catch logging and history tracking
• GPS waypoint mapping and fishing spot recording
• Boat management and service record tracking
• Trip planning tools
• Queensland fishing regulation information
• Spearfishing and crayfish catch tracking
• Weather and tidal condition data

AI recommendations are provided for informational and planning purposes only. They do not constitute professional advice. Always comply with all applicable Queensland and Commonwealth fishing regulations, safety requirements, and marine park rules.

3. User Accounts

To access most features of the Service you must create an account. When creating an account you agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and accept responsibility for all activity under your account
• Notify us immediately of any unauthorised access to your account
• Be at least 13 years of age (or have parental consent if under 18)

You may not create accounts for others without authorisation, use automated tools to create accounts, or transfer your account to another person. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

ReefCast AI offers free and paid subscription plans. Paid features are unlocked through a subscription processed by our payment provider, Stripe, Inc.

4.1 Billing

Subscription fees are billed in advance on a monthly or annual basis depending on the plan selected. All prices are displayed in Australian Dollars (AUD) and include GST where applicable. By subscribing, you authorise us to charge your nominated payment method on a recurring basis until you cancel.

4.2 Cancellation

You may cancel your subscription at any time through the Settings page of the Service or by contacting us. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until that date. We do not provide refunds for partially used billing periods except where required by Australian Consumer Law.

4.3 Price Changes

We may change subscription prices with at least 30 days' advance notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new price.

4.4 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law that cannot be lawfully excluded or limited.

5. User Content

You retain ownership of any catch data, photos, waypoints, notes, and other content you submit to the Service (“User Content”). By submitting User Content, you grant ReefCast AI a non-exclusive, royalty-free, worldwide licence to store, process, and display your content solely for the purpose of operating and improving the Service.

You are solely responsible for your User Content. You must not submit content that is unlawful, defamatory, offensive, infringing of third-party rights, or that contains malware or harmful code. We reserve the right to remove any User Content that violates these Terms.

6. Prohibited Uses

You must not use the Service to:

• Violate any applicable law or regulation, including Queensland fisheries legislation
• Facilitate illegal fishing, poaching, or harvesting of protected species
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Scrape, crawl, or otherwise extract data from the Service by automated means without our consent
• Interfere with or disrupt the integrity or performance of the Service or its infrastructure
• Attempt to gain unauthorised access to any part of the Service or its related systems
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Use the Service for commercial purposes without our express written consent

7. Intellectual Property

The Service, including its software, design, text, graphics, logos, and AI models (excluding User Content), is owned by or licensed to ReefCast AI and is protected by Australian and international intellectual property laws. Nothing in these Terms grants you any right in our intellectual property other than the limited licence to use the Service as described herein.

8. Disclaimer of Warranties

To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. AI-generated fishing recommendations, weather forecasts, and regulatory summaries are provided for convenience only and may not be accurate, complete, or current. Always verify fishing regulations directly with the Queensland Department of Agriculture and Fisheries before fishing.

9. Limitation of Liability

To the maximum extent permitted by applicable law, ReefCast AI and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service.

Our total aggregate liability to you for any claims arising under or in connection with these Terms will not exceed the total fees paid by you to ReefCast AI in the 12 months preceding the event giving rise to the claim, or AUD $100, whichever is greater.

This limitation of liability does not apply where liability cannot be excluded or limited under the Australian Consumer Law or other applicable legislation.

10. Third-Party Services

The Service integrates with third-party services including Stripe (payments), Anthropic (AI features), Google Maps, and weather data providers. Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we decide to discontinue the Service. You may terminate your account at any time by contacting us at the address below.

Upon termination, your right to use the Service ceases immediately. Sections 5, 7, 8, 9, 12, and 13 survive termination.

12. Governing Law and Disputes

These Terms are governed by the laws of Queensland, Australia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts of Queensland, Australia for any dispute arising out of or in connection with these Terms or the Service.

Before commencing any legal proceedings, you agree to attempt to resolve any dispute by contacting us in good faith. We will endeavour to resolve disputes promptly and fairly.

13. General

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. These Terms, together with our Privacy Policy, constitute the entire agreement between you and ReefCast AI regarding the Service and supersede all prior agreements.
